Two laws in South Africa that many of us dont know exist, are there to help those in debt:
1) Prescribed Debt: In terms of the Prescription Act, if a creditor fails to take judgment within three years from the date on which a person defaults on his or her debt, the creditor's claim against the debtor falls away, or prescribes.
In other words, if you owe someone money for longer than 3 years, and they have not got a judgement against you yet, you dont have to pay them - ever!
2) In Duplum: You can never be charged more than double what you owe.
So if you owe someone R100, and dont pay, they can never ask for more than R200 as a once off payment from you. If however you decide to pay them off, as soon as your balance is below R200, they can once again charge interest.
